What Does The Court Look For?
Custody is determined by what is in the best interest of the child. In West Virginia, the court will review things such as:
- The needs of the child
- The ability of each parent to care for the child
- Whether the arrangement will keep some stability in the child’s life
- The parenting arrangement in the 12 months prior to the separation
Additionally, children ages 14 and older may specify which parent they wish to live with.
In most cases, when parents come up with a custody and parenting time agreement that works for their family, the judge will approve it as long as it meets the best interests of the child.
